En el tercer libro de De legibus ac Deo legislatore (1612), su gran obra sobre teología de ley, Francisco Suárez explica y desarrolla su concepto sobre las leyes humanas. Esta teoría de las »leges humanae« forma el centro de la jurisprudencia suariana, tanto por razones histórica scomo sistemáticas: Por un lado, la doctrina del libre albedrío como resultado de su propia metafísica práctica, fuerza al teólogo conimbricense a adoptar una concepción moderna de normatividad. Por otro lado, tanto las teorías políticas desde Niccolò Machiavelli y Jean Bodin como las prácticas políticas del siglo XVI y el temprano siglo XVII, mostraron que las estructuras políticas modernas emergentes avanzaban inexorablemente hacia una autoconcepción laica a la cual Suárez se oponía con su teoría teónoma legal y política.
